Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Handy Golf mobile application (the “App”), our website at [www.handygolf.com], and any related services (collectively, the “Services”) provided by Handy Golf LLC (“we,” “us,” “our,” or “Company”).

By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility and Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement.
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. License and Use of the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Services.

3. User Content

You retain ownership of any content you upload or create (scores, swing videos, notes, photos, etc.). By posting content, you grant us a worldwide, royalty-free license to use, display, and distribute it for operating and improving the Services (including public leaderboards or featured swings if you choose to share publicly).

4. Safety and Responsible Use

The Services include features such as the Swing Mirror, which allows you to connect your device to a television or other display for indoor swing practice and training. Golf swings involve physical movement and equipment. You agree to use the Services, including the Swing Mirror and any indoor practice tools, with reasonable care and attention to your surroundings at all times.

You are solely responsible for preventing any damage to your property or the property of others. This includes, but is not limited to, your television, walls, floors, furniture, lighting, or any other objects in the practice area. We strongly recommend using the Swing Mirror only in a clear, open, and safe space with adequate room, proper lighting, and no breakable or valuable items nearby. We are not responsible for any property damage that results from your use of the Services.

5. Assumption of Risk, Health Representation, and Release of Liability

Golf is a physical activity that carries inherent risks of injury, including but not limited to muscle strains, joint stress, impacts from golf clubs or balls, falls, or other physical harm. By using the Services, you acknowledge and agree that:

  • You are in good physical health and have no medical condition that would prevent you from safely participating in golf practice, swing training, or any related physical activities.

  • You voluntarily assume all risks associated with your use of the Services, including any risks arising from following tips, drills, swing demonstrations, or advice provided within the App or by coaches, influencers, or other users on the Handy Golf platform.

  • You release, discharge, and hold harmless Handy Golf LLC, its officers, directors, employees, agents, affiliates, coaches, influencers, content providers, and any other users from any and all claims, liabilities, damages, losses, or injuries (including death) of any kind, whether known or unknown, arising out of or in any way connected with your use of the Services, including any property damage, personal injury, or medical issues.

This release applies to any and all activities you perform while using the Services, whether indoors, outdoors, or while following any guidance from the App or third-party content creators on the platform.

6. Prohibited Conduct

You may not use the Services to:

  • Violate any law or infringe any rights.

  • Upload harmful code, viruses, or disruptive content.

  • Harass, threaten, or impersonate others.

  • Use the Services in any unsafe manner that could harm yourself or others.

  • Attempt to circumvent any technical measures or security features.

7. Intellectual Property

All content, features, and functionality of the Services (including logos, course maps, swing-analysis algorithms, and designs) are owned by Handy Golf LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8. Payments and Subscriptions

All payments are processed through Apple, Google, or other authorized third-party providers. Subscriptions automatically renew unless canceled. Refunds are governed by the respective app store policies.

9. Billing and Payments

Handy Golf is a freemium application. A free version of the App is always available, providing access to some select tools at no cost. Additional premium features, advanced analytics, unlimited access to certain tools (including but not limited to enhanced Swing Mirror capabilities, ad-free experience, detailed performance insights, or exclusive content), are available only through paid options.

A. Subscriptions (Premium Features)

Premium features are offered via auto-renewing subscriptions (e.g., monthly, annual, or other periods as displayed in the App).

Subscriptions are billed through the Apple App Store or Google Play Store (depending on your platform) or the Handy Golf payment partner if registered on the website.
Payment will be charged to your App Store or Google Play account at confirmation of purchase and automatically renewed at the end of each billing period unless you cancel.
You can manage and cancel your subscription at any time through your device settings:
On iOS: Settings > [Your Name] > Subscriptions.
On Android: Google Play Store > Profile > Payments & subscriptions > Subscriptions.

If you cancel a subscription, you will retain access to premium features until the end of your current paid billing period. No partial refunds or credits will be provided for the remaining portion of the billing period, except as required by applicable law or as otherwise provided in the applicable App Store's refund policy.
After cancellation, your subscription will not renew, and you will revert to the free version of the App with limited features at the end of the current billing period.
We do not offer refunds for subscriptions once charged, except in cases where required by law or processed directly by Apple or Google according to their respective policies.

B. One-Time Purchases

Certain content, features, or items (such as individual golf courses, premium drills, swing analysis packs, downloadable content, or other unlockable elements) may be available as one-time, non-recurring purchases.

These purchases are processed through the Apple App Store or Google Play Store or the Handy Golf payment partner.
All one-time purchases are final and non-refundable, except as required by applicable law or as processed by the respective App Store's refund policy.
Upon successful purchase, you receive perpetual access to the purchased item(s) for as long as the App remains available and supported on the platform, subject to these Terms. Access is tied to your account and may not be transferable. We do not guarantee indefinite availability of any specific purchased content if features or the App are discontinued (see Section 9 – Termination for details).

C. Early Access Period

During the initial "Early Access" launch phase of the App (as determined solely by Handy Golf LLC and announced in the App or on our website), users who create an account and sign up during this period will receive complimentary access to all premium features for a period of three (3) months starting from the date of their initial signup. This Early Access promotion is provided at no cost and is intended to allow early users to fully experience and provide feedback on the premium features.

This complimentary access is personal to the user who signed up during the Early Access window and is non-transferable.
At the end of the 3 month period, unless you purchase a paid subscription, your access to premium features will automatically revert to the free version of the App.
No payment information is required to activate Early Access premium access, but you may be prompted to add payment details if you choose to continue with a subscription after the period ends.
We reserve the right to end the Early Access period, modify its terms, or revoke access at any time for any reason, including but not limited to abuse, fraud, or technical issues. This promotion does not create any obligation for ongoing free access beyond the specified 3 months.

D. Free Trial Offers

From time to time, we may offer a standard free trial for premium features (e.g., a 7-day free trial as displayed in the App at the time of signup)

During the free trial period, you will have full access to the selected premium subscription package at no charge.
To start a free trial, you may be required to provide valid payment information through the Apple App Store or Google Play Store or the Handy Golf website.
If you do not cancel the free trial before it ends, your subscription will automatically convert to a paid subscription at the end of the trial period, and you will be charged the full applicable subscription price (plus any applicable taxes) for the billing period selected at signup. Charges will begin immediately after the trial ends.
You can cancel the trial (and avoid any charges) at any time during the trial period using the cancellation instructions in Section A above.
Free trials are generally available only to new or eligible users (as determined by Apple/Google or us) and may not be combined with other offers unless explicitly stated. We reserve the right to modify, limit, or discontinue free trial offers at any time.

E. General Payment terms

All prices displayed in the App are in the currency shown and include applicable taxes unless otherwise stated.
We do not store or process payment information directly; all transactions are handled securely by Apple or Google per their terms or by the Handy Golf payment partner.
You are responsible for any additional charges from your payment provider (e.g., carrier fees, currency conversion).
In the event of any billing dispute or issue, contact Apple Support (for iOS) or Google Play Support (for Android) directly, as they manage the billing process. We will cooperate with reasonable requests from the platforms but are not responsible for processing refunds ourselves.
We reserve the right to modify pricing for subscriptions or one-time purchases at any time. Price changes will be communicated in advance where required by law or platform rules, and will only apply to new purchases or renewals after the change takes effect.
Promotional offers, trials, or discounts (including Early Access) may be available from time to time and are subject to their specific terms (e.g., trials auto-convert to paid subscriptions unless canceled).

By making any purchase, signing up during Early Access, or starting a free trial in the App, you acknowledge and agree to these billing terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason. Upon termination, your right to use the Services ceases immediately.

11. Limitation of Liability

To the fullest extent permitted by law, Handy Golf LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or $100 if you have not made any payment).

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, your User Content, or your use of the Services.

13. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Utah County, Utah.

14. Changes to These terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms and updating the “Last updated” date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

15. Use of Swing Recordings, Motion Data, and Performance Information

By using Handy Golf and recording golf swings, practice sessions, or other activity within the platform, you grant Handy Golf, LLC a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to use, store, process, analyze, and create derivative works from such recordings and related data for the purpose of operating, improving, and developing the Handy Golf platform and related technologies.

This includes the use of swing recordings, motion capture data, skeletal tracking data, ball flight observations, performance metrics, and other related information to develop and train machine learning models, improve motion detection and analysis systems, enhance instructional tools, generate aggregated insights, and develop new features and services.

Handy Golf may use recordings and derived motion data in aggregated or anonymized form for research, product improvement, benchmarking, statistical analysis, and the development of motion intelligence technologies related to golf performance. Handy Golf will not publicly display or associate identifiable user recordings with an individual without the user’s permission.

Users may choose to opt out of having their recordings and related motion data used for platform improvement and model training through the settings available in their profile. Additional information about how data is collected, used, and protected is described in the Handy Golf Privacy Policy.

16. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not warrant that the Services will be error-free, uninterrupted, or that any golf data (yardages, swing analysis, etc.) will be 100% accurate. Use of the Services is at your own risk.
