Handy Golf — Terms of Service
1) Agreement to Terms
By downloading, accessing, or using Handy Golf’s mobile apps, websites, and related services (the “Services”), you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Services.
2) Eligibility; Accounts; Children & Teens
- Under 13: The Services are not for children under 13.
- Ages 13–17: You may use the Services only with a parent/guardian’s consent where required by law. The adult is responsible for the minor’s use, including any purchases and compliance with these Terms.
- Account Security: You must provide accurate information and keep your login secure. You are responsible for all activity under your account.
3) Changes to the Services or Terms
We may modify the Services and these Terms at any time. If changes are material, we’ll provide notice (e.g., in-app). Continued use after changes means you accept the updated Terms.
4) License and Acceptable Use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own noncommercial purposes. You agree not to:
- Reverse engineer, copy, or resell the Services;
- Bypass security or misuse any reporting/moderation tools;
- Upload anything unlawful, infringing, or harmful;
- Use the Services while driving or in unsafe circumstances.
5) Content You Provide
You retain ownership of content you submit (videos, images, comments, scores). You grant Handy Golf a worldwide, royalty-free license to host, store, reproduce, adapt, and display that content to operate, improve, and promote the Services (as your settings permit). You promise you have the rights to anything you upload.
6) Coaching, Guidance, and No Professional Advice
The Services provide educational golf content, drills, and tools. They are not medical advice, physical therapy, or a substitute for professional coaching tailored to you. You are solely responsible for how you use drills, plans, or tips.
7) Health & Injury Waiver; Assumption of Risk; Medical Clearance
Golf involves physical exertion and inherent risks, including strains, sprains, impact injuries, overuse injuries, slips/falls, and other hazards indoors or outdoors. By using the Services, you: (1) voluntarily assume all risks associated with golf activity and any practice or training you undertake based on the Services; (2) represent that you are physically capable of participating and will consult a physician before beginning or changing any exercise or training routine; (3) agree that you are solely responsible for deciding whether a drill, movement, or routine is appropriate for your condition and environment; and (4) waive and release Handy Golf, our affiliates, and our officers, employees, and contractors from any and all claims, liabilities, losses, or damages for personal injury or death arising out of or related to your use of the Services or participation in any drills or activities suggested by the Services, to the fullest extent permitted by law.
If you experience pain, dizziness, shortness of breath, or discomfort, stop immediately and seek medical advice.
8) Indoor Practice & Property Damage Waiver
Some features encourage indoor practice (e.g., swing rehearsals, putting, impact and tempo work). You are solely responsible for ensuring you have adequate space and a safe environment before practicing. This includes removing breakable items, confirming ceiling/side clearance, keeping bystanders/animals clear, and using appropriate training aids or soft/foam balls where relevant.
By using indoor practice features, you: (1) assume all risk of property damage, including damage to your home, fixtures, furnishings, devices, and third-party property; (2) waive and release any claim against Handy Golf for property damage related to your practice; and (3) agree to indemnify Handy Golf against any third-party claims for property damage arising from your use of the Services, to the fullest extent permitted by law.
9) Release, Hold Harmless, and Indemnification
To the maximum extent allowed by law, you release and covenant not to sue Handy Golf and agree to defend, indemnify, and hold harmless Handy Golf from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your practice activities (indoor or outdoor); (c) your violation of these Terms; or (d) your content or interactions with others.
10) Subscriptions, Trials, and Billing
Some features may require a paid subscription. Unless otherwise stated, subscriptions auto-renew until you cancel through your platform account (e.g., Apple App Store / Google Play). Prices may change on renewal with notice. Taxes may apply. App-store refunds and cancellations are governed by the platform’s policies.
11) Third-Party Services and Links
We may link to or integrate third-party content/SDKs (analytics, payments, storage). Handy Golf is not responsible for third-party terms or privacy practices. Review their policies before using them.
12) Ownership; Feedback
We own the Services and all related IP. If you provide feedback or suggestions, you grant us a free, worldwide, perpetual license to use them without restriction.
13) Safety; Do Not Use in Dangerous Situations
Do not use the Services while driving or when attention to surroundings is required. You are responsible for maintaining awareness of people, pets, and objects around you during any practice.
14) Termination
We may suspend or terminate access for any violation of these Terms or for misuse, fraud, or risks to others. You may stop using the Services at any time. Sections that by their nature should survive termination (including 7–9, 12–17) do survive.
15) Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, HANDY GOLF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.
16) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HANDY GOLF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRACTICE ACTIVITIES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO HANDY GOLF (IF ANY) IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THAT CASE, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
17) Dispute Resolution; Arbitration; Class-Action Waiver
You and Handy Golf agree to resolve disputes by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
No Class Actions: You and Handy Golf waive any right to participate in class, collective, or representative actions.
Small Claims; IP Injunctions: Either party may bring an individual action in small-claims court or seek injunctive relief for IP misuses.
Opt-Out: You may opt out of arbitration within 30 days of first accepting these Terms by sending an email to support@handygolf.com with subject “Arbitration Opt-Out,” including your name and the email tied to your account.
18) International Users
We are based in the United States and make no representation that the Services are appropriate or available in all locations. You are responsible for compliance with local laws.
19) Notices; Electronic Communications
By using the Services, you consent to receive notices and messages electronically. We may send notices by email or through the Services.
20) Severability; Assignment; Entire Agreement
If any provision is unenforceable, it will be modified to the minimum extent necessary; the remainder remains in effect. You may not assign these Terms without our consent. These Terms (plus policies referenced here) are the entire agreement between you and us.
